Terms of Service

1. Scope

These Terms of Service apply to the use of the web application "CELUSH'S CODING TOOLS" between you and me, Celina Böhm.

2. Service description

CELUSH'S CODING TOOLS provides digital creator tools and related resources, including template generation, preset functionality, and tutorial content.

3. Access and account

Access to protected areas may be provided through Patreon OAuth. Access may be restricted or suspended where reasonably necessary for maintenance, security, legal compliance, or abuse prevention.

4. Fees and billing

If paid access is offered, pricing and billing are based on the selected Patreon membership tier. Payment processing is handled by Patreon.

5. Acceptable use

• No unauthorized sharing of paid access.
• No attempts to bypass security or access restrictions.
• No abusive automated use that harms service availability.
• You may only upload images that you have the necessary rights to use and modify.
• You are solely responsible for ensuring that uploaded images and generated outputs do not violate third-party rights or terms.

If I notice or reasonably suspect a violation of these Terms, I may suspend, restrict, or permanently ban your access to the tool.

6. Intellectual property and license

Unless otherwise stated, all software, tools, generated templates, overlays, and related content provided by CELUSH'S CODING TOOLS remain my intellectual property.

Upon creation, you are granted a non-exclusive, non-transferable license to use the generated templates and overlays for your personal and commercial projects.

• Sharing, reselling, sublicensing, or distributing generated templates or generated overlays to third parties is prohibited.
• Mass-sharing generated assets from this tool, including publishing asset packs, bulk downloads, public folders, or redistributed collections, is prohibited.
• Removing or altering embedded credits or attribution included in generated templates is prohibited.

The right to use generated templates and overlays remains valid even after the termination or cancellation of your subscription, provided that the content was created during an active subscription period.

7. Availability and changes

I may update, modify, or discontinue parts of the service where reasonably necessary for technical, security, legal, or development reasons.

8. Liability

I am liable without limitation for intent and gross negligence. In cases of slight negligence, liability is limited to breaches of essential contractual obligations and to foreseeable damage typical for this type of contract. Mandatory statutory liability remains unaffected.

9. No guarantee of results

The tools and generated outputs provided by CELUSH'S CODING TOOLS are intended to assist users in creating scripts, templates, and overlays. Due to the technical nature and complexity of these processes, correct results depend on proper user input and usage.

I do not guarantee that generated outputs will be error-free, fully functional, or suitable for every specific use case.

Users are responsible for reviewing, testing, and adapting generated content before using it in their projects.

Paid access, if applicable, depends on the status of the relevant Patreon membership. Cancellation and membership management are handled through Patreon.

10. Consumer rights

Mandatory consumer protection rights remain unaffected. Where required by law, additional information on withdrawal rights for digital services or digital content will be provided separately.

11. Governing law

German law applies to the extent legally permissible, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
